Raleigh, N.C. — Raleigh police arrested a North Carolina State University student last week who was accused of creating a "monster" out of construction barrels and placing it on the side of the road.
Authorities charged Joseph Carnevale with larceny for taking materials from a construction site at a roundabout project to create the monster.

"The unlawful taking and removing of another's personal property with the intent of permanently depriving the owner; theft."
looks like he actaually returned the barrels, albeit not in its original form. besides, it's probably much more effective in slowing down traffic through the construction area than those barrels themselves.

How could you charge someone after making something that awesome.
Good shit.

That's exactly what I was thinking. They could sue him for conversion of their property in a civil suit, but the criminal act of larceny under common law doesn't apply. They may have some other criminal statute on the books that's applicable though. Cool looking monster.
That's pretty cool. Harmless though really, I don't think he should be charged with anything. If he gets charged, then the entire traveling public should be charged with vandalism. They see orange on the side of the road and it's like they aim for it.
RALEIGH -- Joseph Carnevale didn't have a grandiose point when he chopped up traffic barrels and turned them into a hitchhiking roadside monster, but the North Carolina State University student has become a celebrity since city police arrested him.
He has hundreds of followers on Facebook and numerous hits on his personal Web site. Even the construction company he stole from wants a replica of the "barrel monster."
Carnevale took three traffic barrels from roadside construction
near the N.C. State campus on May 31. He reassembled it into a
hitchhiking, 10-foot figure looking toward passing vehicles.
Raleigh police arrested Carnevale on June 10, charging him with
larceny and destruction of property. He's scheduled to appear in court next month.

As far as larceny, no.. I don't think anything will happen.
If the DA/Prosecutor wants to force the matter, he could make the case that sculpture is a public hazard... If the construction company declines to press charges, there isn't any real purpose to pursuing criminal charges. I'll frankly be surprised if it even sees a courtroom.
